Terms of Service

These Terms of Service (the "Terms") set out the conditions for using the iOS application "ROCX" (the "App") provided by ABEYA, LIMITED LIABILITY COMPANY (Godo Kaisha Abeya) ("we," "us," or "our"). By downloading, installing, or using the App, you are deemed to have agreed to these Terms.

1. License

We grant you a non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms and Apple Inc.'s Standard End User License Agreement.

You may not reverse engineer, decompile, redistribute, modify, or commercially resell the App.

2. Health and Medical Disclaimer

The App is a tool intended to help you record and manage exercise and health-related information.

The App is not a medical device. It is not intended for diagnosis, treatment, prevention, or cure, and it does not replace advice or care from physicians, pharmacists, physical therapists, or other healthcare professionals.
Information, estimates, suggestions, and other content displayed by the App are provided for reference only and are not medical advice.
If you have a medical history, cardiovascular disease, or other health concerns, consult a healthcare professional before starting exercise.
We are not responsible for physical injury, health issues, or other damage arising from your use of the App.

3. User Responsibilities

You are responsible for the accuracy of information you enter into the App.
You are responsible for appropriately managing data in the App. We are not responsible for loss of data caused by device failure, OS updates, failed app updates, failed data migration, or similar events.
You must not use the App for illegal purposes, to infringe the rights of third parties, or to interfere with our services.

4. Subscriptions and Billing

The App may offer in-app purchases or subscriptions through the Apple App Store. Billing, renewal, cancellation, and refunds are handled according to Apple's terms and the App Store mechanisms.

5. Third-Party Services

The App may use third-party services for feature delivery, operations, maintenance, billing, security, and similar purposes. We are not responsible for the availability, performance, changes, or discontinuation of those services. For information handling, please see the Privacy Policy.

6. Displayed Content, Estimates, and Similar Information

Content, estimates, suggestions, import results, and other information displayed or generated by the App are reference information based on your input and available data. We do not guarantee accuracy, completeness, or fitness for a particular purpose.

You should review and correct the App's displayed content as needed before relying on it.

7. Changes or Discontinuation of Service

We may add, change, discontinue, or stop providing App features without prior notice. We are not responsible for damage arising from such changes or discontinuation.

8. Intellectual Property

All intellectual property rights related to the App, logos, designs, source code, documents, and other content provided by us belong to us or the lawful rights holders.

Content you create or save in the App belongs to you. We use that content only within the scope necessary to provide, operate, maintain, and support the App and as otherwise described in the Privacy Policy.

9. Disclaimer and Limitation of Liability

To the maximum extent permitted by law, we are not liable for any direct, indirect, incidental, special, consequential, or derivative damages arising from use of, or inability to use, the App.

The App is provided "as is," without express or implied warranties, including warranties of fitness for a particular purpose, merchantability, or non-infringement of third-party rights.

10. Changes to These Terms

We may change these Terms from time to time. If we make material changes, we will provide notice in the App or on the support site at https://rocxapp.com/. If you continue using the App after the changes, you are deemed to have agreed to the revised Terms.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of Japan. If a dispute arises in connection with these Terms or the App, the Tokyo Summary Court or the Tokyo District Court has exclusive jurisdiction as the court of first instance.
